Mediation

Skilled mediation leads to a just process which increases the chances of a joint resolution and the likelihood of sustained implementation.

The preferred mediation model is Facilitative Mediation, a process that seeks to reach a point where both parties move towards making decisions that work for them both in the future. This does not focus on forcing a compromised outcome, but rather having both parties feel the process was procedurally just.

Key elements of the mediation process:

  • It is voluntary for both parties and the mediator.

  • A pre-mediation discussion takes place with each party separately for 90 minutes each.

  • The mediation may take at least three hours and run over several sessions.

  • Mediation is not a guarantee of success, but it has been shown to increase the likelihood of a positive resolution.
